Following a communication from the holder, Amryt Research Limited, the International Bureau has been informed that the holder's right of disposal of the above-mentioned international registrations has been restricted in all the designated Contracting Parties, following the execution of a Debenture, dated 18 February 2022, in favour of Ares Capital Corporation.
Following a communication from the representative, Best Rechtsanwälte, dated 13 June 2023, the International Bureau has been informed that the restriction of the holder's right of disposal of the above-mentioned international registrations, in all the designated Contracting Parties, has to be removed. Under the terms of a Trademark Release dated 13 April 2023, Ares Capital Corporation has terminated and released the Debenture dated 18 February 2022, including the entirety of its security interests granted therein, including the international trademarks identified in the table above. The Trademark Release states: "Grantee hereby terminates, releases and discharges its continuing security interest in and liens on Grantors' entire right, title and interest in and to and under the United States Trademark registrations and Trademark applications listed on Annex II attached hereto, together with (a) all renewals or extensions thereof".
